Invitation emails sent by Facebook to recipients, who are not members of this social network, must be qualified as unreasonable harassment in terms of § 7 (2) (3) of the German Fair Trade Practises Act (dUWG). If Facebook misleads its users about the way and the extent of the use of data, this must be qualified as a deception in terms of § 5 (1) dUWG. [BGH (German Supreme Court) 14.01.2016, I ZR 65/14]
